Detective sergeant Higham, did not make his own witness statement, dated, 25 August 1985 - instead it was made on his behalf, in his absence, by Detective Constable Richardson...
Richardson made Highams statement for him, in is absence, some seven months after the alleged events had taken place, because Richardson and Higham claimed they made their notes up together in their respective pocketbooks, 44854 and 44787, before they had gone off duty at 12:45am, on 26 January 1987...
An investigation, carried out by Greater Manchester police in 1990, established that Richardson did not have pocketbook, 44787 issued to him until 31 January 1987, and therefore he could not have made his notes up in that book, along with DS Higham, before he had gone off duty at 12:45am, on 26 January 1987...
When Richardson was interviewed by Greater Manchester police in 1990, and it was pointed out to him that his pocketbook, 44787, which contained the relevant information, had not been issued to him, until 31 January 1987, and therefore he could not have made his notes up as alleged, Richardson changed his story, and said that he had actually written up his notes on a piece of foolscap paper, which he later copied into pocketbook, 44787, when it was issued to him on 31 January 1987...
Manchester police then interviewed DS Higham and told him that Richardson was now saying that he made his notes up on a piece of foolscap paper, on 26 January 1987, which he later copied into his pocketbook once it was issued to him on 31 January 1987, but DS Higham continued to maintain that he did not, and that Richardson had written up his notes directly into his pocketbook, 44787, on that occasion...
The evidence relied upon by DS Higham and DC Richardson regarding this matter, was further complicated because of the fact that DS Higham had signed DC Richardsons pocketbook entries, 44787, dated 25 January 1987, and therefore, he would have known that Richardson had not written up those notes in that pocketbook, on 26 January 1987, because that pocketbook, 44787, was not issued to DC Richardson, until 31 January 1987...
Both DS Higham and DC Richardson lied whilst testifying at Mike Tesko's trial, and they were giving conflicting accounts about the same matter, at the time they were being interviewed by Greater Manchester police...
At Mike Tesko's appeal, 1994, Richardson would testify along the lines giving the same explanation he gave to Greater Manchester police in 1990, and DS Higham was not called to testify despite him continuing to maintain that DC Richardson had written his notes up directly into pocketbook, 44787, and that Richardson had not written his notes up on a piece of foolscap paper... |
